Terribly sad story, all around, but glad his family’s getting justice.
Murder charges are further divided based on the severity and other circumstances surrounding the crime. While many states separate murder charges into first and second degree murder, Texas law makes a distinction between “capital murder” and “murder.”
In order to be charged with murder, the defendant must have knowingly and willingly caused the death of another person . The biggest distinguishing factor between murder and manslaughter involves the intent of the perpetrator. If the defendant intended to cause serious bodily harm or death, or intended to commit a felony other than manslaughter that resulted in death, he or she can be charged with murder.
The distinction between capital murder and murder is made when the killing was committed in a way that can result in capital punishment in Texas. Some of the criteria for capital murder include killing a police officer or firefighter, having been paid to commit murder, murdering someone in prison, or killing more than one person.

I concur, but her lack of concern for Mr. Jean should be an aggravating factor in what sentence she receives.
She never once attempted to render aid, and was more concerned for her career. When an officer thinks that way, they are unsuited to the job.

I was prepared to argue this with you but I thought about it more and agree, to an extent. Should she be sentenced to spend the rest of her life in prison, no; if she dies in prison while serving a shorter sentence than life in prison , oh well.
I do believe that given the situation sentenced to anything under 40 years is inappropriate. Under 30 years is a joke. Under 20 years is criminal.

Guyger’s attorneys argued that Guyger reasonably believed she was in her own apartment when she shot Botham Jean. But she wasn’t in her apartment. She was in HIS apartment. Guyger went into a black man’s apartment and shot him to death, while he was watching TV and eating ice cream, and claimed that the shooting was justified because she thought she owned the place.
THAT was her defense? I mean, dumber things have happened before (see: “Affluenza” kid) but did they seriously think that was going to work?

Seems too harsh for me, honestly. A 10-20 year sentence (5-10 served for good behavior) would be fair in my mind, though police officers should be held to a higher standard, so maybe 20 (10) is actually more appropriate.

Texas has laws on the books that make it legal to use lethal force against someone who has entered your home under certain circumstances . She had already admitted to shooting and killing him so they had to come up with something to try to claim that a murder isn’t a murder.

I’d assume because if you are already in prison, being sent to prison is not necessarily much of a penalty. Opening up the death penalty as an option thus provides and additional disincentive.

This feels about right to me. This was bad, but it’s not like this was something she planned out or anything., which I think should be a big mitigating factor in sentencing. The flip side is that it does appear that she didn’t even attempt to render aid (and then lied about that), instead reaching out to her partner/boyfriend and then her supervisor instead of even trying to save her victim. I definitely think less than a 10-year sentence would come across as lenient to me.

Well, my guess would be that they hope potential murderers have read the law, and know that successfully killing the police officer trying to arrest them will mean they might die, but surrendering is a much lower sentence... so perps will just not resist.
Not sure why firefighters are lumped in... maybe so that people being rescued from their burning home won’t defend their castle to the last man ala the Alamo.
